9th Beach Tennis Orlando Open

Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of being permitted to participate in any way in the 9th Beach Tennis Orlando Open and its activities (“Activity”) I, for myself for personal representatives, assigns, heirs and next of kin:
1) ACKNOWLEDGE, agree, and represent that I understand the nature of the 8th Beach Tennis Orlando Open, to be held on December 12th, 13th and 14th, of 2025, at Hickory Point Park, 27341 State Road 19, Tavares/FL, 32778 and that I am qualified, in good health and in proper physical condition to participate in such activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.
2) FULLY UNDERSTAND THAT: (a) THIS SPORTS ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY,INCLUDING PERMANENT DISABILITY,PARALYSIS,AND DEATH (“RISK”);(b) these Risks and danger may be caused by my own actions or inaction, the action or inaction of other participating in the Activity, the condition in which the Activity take place, or THE NEGLIGENCE OF THE “RELEASE” NAMED BELOW;(c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time, and I FULLY ACCEPT AND ASSUME ALL SUCH RISK AND ALL RESPONSIBILITY FOR LOSSES,COST AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.
3) HERBY RELEASE,DISCHARGE, AND CONVENT NOT TO SUE BEACH TENNIS ORLANDO LLC, their respective administrators, directors, agents, officers, members, volunteers and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity take place, (each considered one of the “RELEASES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY,ASSUMPTION OR RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf , makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.
4) WILLINGLY CONSENT to be filmed, live, taped or filmed television footage or photos during Official Activity without compensation, and hereby waives any right to such compensation for participant, b) The right to grant and/or assign licenses or transfer that right and licenses mentioned herein at their sole discretion to any third party.
5) BY COMPLETING THIS ORDER AND OBTAINING CONFIRMATION OF SUCH ORDER, I/WE ACKNOWLEDGE OUR AGREEMENT OF ALL THE ABOVE TERMS.

RELEASE, PERMISSION, AND INDEMNITY AGREEMENT
Release. In consideration of being permitted to participate in any way in the:
Event Name: 9th Beach Tennis Orlando Open, on December 12th, 13th and 14th, of 2025, at Hickory Point Park, 27341 State Road 19, Tavares/FL, 32778 I, for myself, my heirs or assigns, hereby release, waive, discharge and covenant not to BEACH TENNIS ORLANDO LLC directors, officers, employees, other participants, volunteers, and agents from liability from any and all claims resulting in personal injuries, death, accidents, illnesses (such as communicable diseases including COVID-19), and property loss arising from, but not limited to, participation in the Event, whether arising from the negligence of releasees or otherwise.

Assumption of Risk. Participation in the Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary but include 1) minor injuries such as bruises, sprains and dehydration, 2) major injuries such as eye injuries, joint or back injuries, heat stroke, heart attacks, and concussions, and 3) catastrophic injuries such as paralysis and death. I have read the previous paragraphs and I know, understand and appreciate these and other risks that are inherent in the participation of this event. I assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification and Hold Harmless. I also agree to indemnify and hold BEACH TENNIS ORLANDO LLC and all named above harmless from any and all claims, actions, suits, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in the Event.

Use Permission. I also give BEACH TENNIS ORLANDO LLC and its agents and designees permission to use or distribute, without limitation or obligation, my image, name, voice, and words for any purpose connected with the Event, including promotional, marketing, training, informational, and archival uses.

Please contact Thiago Maul and Luciana Galimberti to change your registration to a future tournament/ranking if you have:
1. Been in contact with anyone who tested positive for COVID in the last two weeks
2. Are currently or at time of tournament waiting for COVID test results
3. Currently have a fever, dry cough, or no sense of taste or smell
4. Have had a positive COVID test result in the last two weeks
